Acceptance of Terms
By engaging Puget Properties for property management services or using our website and owner portal, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
We reserve the right to update or modify these terms at any time. Your continued use of our services after any changes constitutes acceptance of the revised terms.
Services Description
Puget Properties provides professional property management services across the Puget Sound region, including but not limited to:
- Tenant screening, placement, and lease administration
- Rent collection and financial reporting for property owners
- Property maintenance coordination and emergency response
- Market analysis and rental pricing optimization using AI technology
- Regular property inspections and condition reporting
- Lease enforcement and compliance with Washington state landlord-tenant law
- Owner portal access for real-time financial and property data
The specific scope of services for each property is defined in the individual management agreement between Puget Properties and the property owner.
Management Agreements
All property management services are governed by a written management agreement that outlines:
- The specific property or properties to be managed
- The scope of management services to be provided
- Management fees and payment terms
- Duration of the agreement and renewal terms
- Termination procedures and notice requirements
- Owner and manager responsibilities
In the event of a conflict between these Terms of Service and your individual management agreement, the management agreement shall prevail.
Fees and Billing
Our fee structure is transparent and detailed in your management agreement. General terms include:
- Management fees are calculated as a percentage of monthly rent collected
- Leasing fees may apply for tenant placement services
- Maintenance and repair costs are passed through at actual cost with no hidden markups
- Owner disbursements are processed on a monthly schedule as specified in the management agreement
- Detailed monthly financial statements are provided through the owner portal
- Year-end tax documentation including 1099 forms is provided at no additional charge
Property Owner Responsibilities
As a property owner engaging our services, you agree to:
- Maintain adequate property insurance and provide proof of coverage
- Fund necessary repairs and maintenance in a timely manner
- Comply with all applicable federal, state, and local laws, including fair housing regulations
- Disclose all known material defects and property conditions
- Maintain a reserve fund as recommended for emergency repairs
- Respond to communications from Puget Properties regarding property decisions requiring owner approval
- Provide accurate ownership and financial information
Tenant Relations
Puget Properties acts as the authorized agent of the property owner in all tenant interactions. This includes:
- Screening and selecting qualified tenants in accordance with fair housing laws and our published screening criteria
- Executing lease agreements on behalf of the property owner
- Collecting rent, security deposits, and other tenant payments
- Handling maintenance requests and coordinating repairs
- Issuing notices and managing lease enforcement in compliance with Washington state law
- Managing the eviction process when necessary, in coordination with legal counsel
Property owners agree not to contact tenants directly regarding property management matters without prior coordination with Puget Properties, to ensure consistent and legally compliant communication.
Limitation of Liability
To the fullest extent permitted by applicable law, Puget Properties and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:
- Tenant defaults, including non-payment of rent or property damage caused by tenants
- Market fluctuations affecting property values or rental rates
- Delays in maintenance or repairs caused by vendor availability or supply chain issues
- Acts of nature, including floods, earthquakes, storms, or other force majeure events
- Errors or inaccuracies in AI-generated analytics or market projections
- Unauthorized access to the owner portal or data breaches beyond our reasonable control
Our total liability for any claim arising from these terms or your use of our services shall not exceed the total management fees paid to Puget Properties in the twelve months preceding the claim.
Termination
Either party may terminate the management agreement with 30 days written notice. Upon termination:
- All property-related documents, keys, and security deposits will be transferred to the property owner or their designated representative
- A final financial accounting will be provided within 30 days of the termination date
- Any outstanding management fees or expenses will be settled
- Existing lease agreements with tenants remain in effect and transfer to the owner or new management
Changes to Terms
We reserve the right to modify these Terms of Service at any time. When we make changes, we will update the "Last updated" date at the bottom of this page. We may also notify you of significant changes via email or a prominent notice on our website.
Your continued use of our services after any modifications indicates your acceptance of the updated terms. We encourage you to review this page periodically.
